Western Dairy Research, Inc. (WDR) warrants to
buyer that product sold by WDR is free from defects in material and workmanship
for a period of one (1) year from the date of delivery to the customer. WDR's
sole obligation and buyer's exclusive remedy for defects in the product shall be
limited, at WDR's option, to either the repair or replacement of the product
determined by WDR to be defective. Repair or replacement of the product shall be
FOB WDR's Lake Forest, California, USA, offices. Any claim by buyer must be made
by buyer to WDR in writing within ten (10) days of the discovery of the claimed
defect but in no event after the expiration of the above stated warranty period,
whichever date is earlier.
This warranty is the sole warranty covering the
product and WDR makes no other warranty of any kind, whether express, implied,
or statutory, and all implied warranties of merchantability and fitness for a
particular purpose are hereby disclaimed and excluded from this warranty. In no
event shall WDR be liable for consequential or incidental damages howsoever
arising from WDR's performance or this warranty or the performance of the
product.
This warranty is not transferable or assignable
and shall not apply to products which have been repaired or altered other than
by WDR, or to damage or defects caused by accident, vandalism, acts of God,
normal wear and tear, or to other causes beyond WDR's control. WDR shall have no
liability to buyer for any damages, compensatory or otherwise, for injuries to
persons (including buyer's employees) or damage to property.
By acceptance of the product, buyer agrees to the
above provisions, terms, and conditions of this limited warranty.
